This website is operated by Roberta Heslop Art. I am Roberta Heslop, trading as Roberta Heslop Art. In these terms, “I”, “me” and “my” refer to Roberta Heslop Art. I offer this website, including all information, tools and services available to you, the user, conditioned upon your acceptance of all terms, conditions, and notices stated here.
By visiting my site and/or purchasing artwork or commissioning a piece, you engage in my “Service” and agree to be bound by the following Terms of Service (“Terms”), including any additional terms and policies referenced here or available by hyperlink. These Terms apply to all users of the site, including browsers, collectors, customers, and contributors of content.
Please read these Terms carefully before using my website. If you do not agree to them, you may not access the site or use any services.
My store is hosted on Shopify Inc., which provides me with the e-commerce platform that allows me to offer products and services to you.
1. ELIGIBILITY
By agreeing to these Terms, you confirm that you are of legal age in your country of residence, or have received permission from a legal guardian to use this site.
2. ORIGINAL ARTWORK & COMMISSIONS
I offer original, one-of-a-kind artwork and limited commissions. Each piece is created with intention and authenticity. I reserve the right to decline commission requests at my discretion.
3. SALES & PAYMENT
Full payment is required through the standard online checkout. Interest-free payment plans are available on all available original paintings by prior agreement. A 30% reservation deposit forms part of the purchase price. The remaining balance is paid monthly over up to 12 months, agreed individually before you commit. Your painting is taken off sale once the agreed deposit has cleared and stored safely in my studio until all payments clear. The total price, delivery arrangements, payment dates and cancellation terms are confirmed in writing before payment. The agreed price is fixed for that plan. Payment-plan collectors worldwide can cancel before delivery or collection for a full refund of everything paid, including the deposit. After receiving the painting, you have 14 days to request a return, then another 14 days to send it back. See the refund policy for details. See my payment-plan information.
4. SHIPPING & DELIVERY
I ship worldwide. All artwork is securely packaged and fully insured. Original works are typically dispatched within 5 business days of full payment, unless a different date is agreed. Payment-plan artworks are not dispatched or released for collection until the final payment and any agreed delivery charges have cleared. Delivery timelines vary depending on location and carrier. Customers are responsible for any customs or import duties.
5. RETURNS & DAMAGES
Original artworks are offered as one-of-a-kind pieces, created by me and sold through this website.
Each piece may have limited availability and is sold on a first-come, first-served basis. I reserve the right to limit the sale of any product or service to any individual, geographic region, or jurisdiction, and may do so on a case-by-case basis.
While every effort is made to display artwork as accurately as possible, I cannot guarantee exact colour representation due to variations in screen display.
Returns & Exchanges:
Your statutory cancellation and refund rights are unaffected. In addition to those rights, I offer a one-time exchange or store credit within 7 days of delivery, if the piece is returned in its original condition and packaging. Return shipping is at the customer’s expense. Please contact me in advance to arrange any exchange.
Damage in Transit:
If your order arrives damaged, please notify me within 48 hours of delivery at roberta@robertaheslop.com with photographic evidence. I will assist in submitting an insurance claim and offer options for repair, replacement, or credit.
Commissions:
Bespoke commissioned pieces are generally excluded from change-of-mind cancellation rights. Your rights where artwork is faulty, damaged or not as described are unaffected.
6. PRODUCT REPRESENTATION
I make every effort to display the colours and details of artwork accurately. However, differences in screen resolution may affect how colours appear on your device. If you’d like more clarity before purchasing, please feel free to get in touch.
7. LIMITED AVAILABILITY
Many of the pieces listed are one-off works and may not be restocked. Once sold, originals are no longer available unless by bespoke commission. I reserve the right to limit or cancel sales at my discretion.
8. INTELLECTUAL PROPERTY
All artwork, content, and images on this website are the property of Roberta Heslop and may not be copied, reproduced, or used for commercial purposes without express written consent.
9. THIRD-PARTY LINKS
Some links on my site may lead to third-party websites. I am not responsible for the content or privacy practices of these sites. Please review their policies before engaging.
10. COMMENTS & FEEDBACK
I welcome your feedback and may use comments or testimonials in future marketing materials. I will not publish any personal details without your consent.
11. PRIVACY
Your use of this site is also governed by my Privacy Policy, which outlines how I collect and protect your information.
